New Jersey Jury Returns $200,000 Verdict After Car Accident
In May, A New Jersey woman received $100,000 after being injured in a car accident. The woman was driving in Long Branch New Jersey with the right of way when struck by another vehicle attempting to make a left hand turn in front of her vehicle at an intersection. As a result of the accident, the woman filed a lawsuit against the other driver claiming negligence. The woman claimed that she suffered mutliple disc herniataions in her back as a result of the accident. The plaintiff's lawyers argued that the defendant not only failed to yield to right-of-way traffic but also did not come to a complete stop at the stop sign before the intersection. The defense claimed that the woman's back conditions were pre-existing and were not attributed to the recent accident. The jury determined that the plaintiff's injuries were related to this accident and returned a damage award to the plaintiff in the amount of $200,000. However, there was a pretrial stipulation that capped any damage award to exceed the insurance policy limit of $100,000 so the plaintiff received an actual award of $100,000.
