New Jersey Wrongful Death Case Ends in $1,750,000 Settlement
In August of 2006, a New Jersey foreman that was supervising a pile-driver on a construction site was killed when the machine malfunctioned and caused one of the piles to strike him. The foreman died within minutes of the injury on the New Jersey construction site.
The family of the foreman filed a wrongful death lawsuit against the subcontractor and general contractor claiming that the pile-driving machine was operated negligently and that the jobsite failed to abide by proper safety procedures. The New Jersey wrongful death case resulted in a settlement to the plaintiff in the amount of $1,750,000. The entire settlement was paid by the subcontractor under an indemnification agreement.
